The Separation of Powers, Judicial Review, and the Common Good

This paper explores how concern for the common good should affect how legal officials (judges/executive officials) and lawyers’ approach to legal/constitutional interpretation. It also explores the role judicial review plays in a constitutionalism oriented to the common good. It will compare and contrast the approach toward same of ‘common good constitutionalism’ and the UK’s tradition of ‘common law constitutionalism’
